These Terms of Service govern your use of callofdoody.us and any booking, scheduling, or pump-out services provided by Call of Doody (“Call of Doody,” “we,” “us,” or “our”).
1. Acceptance of Terms
By accessing this website, contacting us, requesting a quote, or booking service, you agree to these Terms. If you do not agree, do not use the website or services.
2. Service Area and Seasonal Operation
We provide mobile marine pump-out services for boat holding tanks on the South Shore of Long Island, including coverage from Freeport to the Patchogue River, plus all of Fire Island (collectively, the “Service Area”).
- Open season: April 1 through October 31
- Closed season: November 1 through March 31
We may decline requests outside the Service Area or outside the open season. We may also delay, limit, or decline service due to weather, tides, access limitations, unsafe conditions, equipment maintenance, or staffing.
3. Bookings, Scheduling, and Service Windows
When you request service, you agree to provide accurate details including location, dock access instructions, vessel information when requested, and preferred timing. Appointment times are generally service windows, not exact arrival guarantees. We will make reasonable efforts to arrive within the window provided.
If we cannot complete service due to access issues, inaccurate information, unsafe conditions, marina restrictions, or equipment incompatibility, you may be responsible for a trip charge or minimum service fee if disclosed at booking.
4. Pricing, Payment, and Taxes
Prices may vary based on location, access, vessel setup, tank size, timing, add-ons, and service conditions. Any quoted price may change if actual job conditions materially differ from what was described during booking.
Payment terms, including accepted payment methods, deposits, or on-site payment requirements, will be presented during booking or before service is performed. You authorize us and any payment processor we use to charge the payment method provided for approved charges.
5. Cancellations and No-Shows
If you need to cancel or reschedule, contact us as soon as possible. Late cancellations, no-shows, or situations where service cannot be completed because the vessel, dock, or service point is not accessible or ready may result in a fee if disclosed at booking.
6. Dock Access, Safety, and Customer Responsibilities
You are responsible for providing safe and lawful access to the vessel and dock area, and for ensuring the pump-out fitting, venting, and related components are accessible and in reasonably serviceable condition. You agree to:
- Provide clear instructions for dock access, gate codes, marina rules, and contact details.
- Ensure the deck fitting labeled for waste is accessible and can be safely opened and closed.
- Ensure pets, hazards, and obstructions are controlled so service can be performed safely.
- Comply with all applicable marina rules and local, state, and federal requirements.
We may refuse, pause, or stop service if we determine conditions are unsafe, unlawful, or materially different from what was described.
7. Weather, Force Majeure, and Service Interruptions
Service may be delayed, rescheduled, or canceled due to circumstances beyond our control, including severe weather, hazardous water conditions, mechanical issues, marina restrictions, emergencies, or other events that make service impractical or unsafe. In those situations, we will make reasonable efforts to reschedule.
8. Service Communications
If you provide your contact information, you consent to receive service-related communications from us, including phone calls and emails, for purposes such as scheduling, confirmations, arrival updates, payment matters, and completion notices.
9. Website Use and Prohibited Conduct
You agree not to misuse the website. Prohibited conduct includes attempting to disrupt site operations, scrape content at scale, introduce malware, interfere with website security, or use the site for unlawful purposes.
10. Intellectual Property
The website, branding, logos, graphics, text, layout, and other site content are owned by or licensed to Call of Doody and are protected by applicable intellectual property laws. You may not copy, reuse, reproduce, or distribute site content without written permission, except for ordinary personal, non-commercial use of the website.
11. Disclaimers
The website is provided on an “as is” and “as available” basis. We do not guarantee that the website will always be available, uninterrupted, secure, or error-free. Service outcomes may vary based on vessel setup, holding tank condition, venting, access limitations, and other factors beyond our control.
12. Limitation of Liability
To the maximum extent permitted by law, Call of Doody will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, business, or data arising out of or related to the website or services. Our total liability for any claim related to a specific service will not exceed the amount you paid us for that service.
13. Indemnification
You agree to defend, indemnify, and hold harmless Call of Doody from claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the website, your breach of these Terms, or unsafe, unlawful, or inaccurate conditions or information connected to the service location.
14. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. You agree that any dispute arising from these Terms, the website, or our services will be brought in the state or federal courts located in New York, and you consent to the jurisdiction of those courts.
